I BELIEVE IT'S IMPORTANT TO GET THE RIGHT REGULATIONS IN PLACE FROM THE START, TO PROTECT OUR RESIDENTS, AND TO ATTRACT RESPONSIBLE CORPORATE CITIZENS TO OUR CITY. WITHOUT PROPER ORDINANCES, DATA CENTER PROPOSALS WILL MEET WITH PROTEST AND WILL FAIL. WE'VE SEEN THIS IN 2025. IN OLDHAM, MEAD AND SIMPSON COUNTIES. FOR RESIDENTS, THE THREAT OF GREATLY INCREASED NOISE FROM DIESEL GENERATORS, INCREASED AIR POLLUTION, HIGH WATER CONSUMPTION, HIGH UTILITY RATES, HUGE CAMPUSES OF BUILDINGS AND THE PROSPECT OF COPING WITH GIANT, POTENTIALLY UNRESPONSIBLE CORPORATIONS CAUSES ALARM. WHY WOULDN'T IT? NOT IN MY BACKYARD IS AN UNDERSTANDABLE REACTION. ON THE OTHER SIDE OF THE ARGUMENT ARE THOSE WHO WELCOME THE INCREASED PRODUCTIVITY OF ARTIFICIAL INTELLIGENCE. MANY OF US USE ALEXA, SIRI, GOOGLE MAPS, AUTOCORRECT, CLOUD STORAGE, AND OTHER APPLICATIONS AND DATA CENTERS COME WITH THE PROMISE OF INCREASED PROPERTY TAX REVENUES. OUR SCHOOLS AND MUNICIPAL FIRE DEPARTMENTS WILL WELCOME THIS REVENUE. THE GOOD NEWS IS THAT WITH PROPER REGULATIONS IN PLACE, THE COMMUNITY BENEFITS OF AI AND OF INCREASED PROPERTY TAXES CAN BE ACHIEVED, WHILE HARMFUL EFFECTS

CAN BE MINIMIZED, MINIMIZED, BRING IN RENEWABLE ENERGY AND BOTH ENVIRONMENTAL AND ENERGY COSTS ARE MINIMIZED AS WELL. IN ADDITION TO LIMITING THE LOCATION OF DATA CENTERS TO INDUSTRIAL ZONES, THE CRCW MODEL REQUIRES A CONDITIONAL USE PERMIT, WHICH CREATES A SITE SPECIFIC, TAILORED APPROACH TO AVOID ADVERSE IMPACTS LIKE HIGH NOISE AND WATER USAGE. THE DEVELOPER WILL BE REQUIRED TO SUBMIT A MITIGATION PLAN AND PAY FOR AN INDEPENDENT EXPERT REVIEW OF THEIR APPLICATION. THIS REVIEW PROCESS WILL INCREASE PUBLIC CONFIDENCE IN THE ACCURACY OF SUBMITTED INFORMATION AND HEAD OFF POTENTIAL PROBLEMS, MAKING THE DATA CENTER A BETTER FIT. I THINK WE ALL CAN AGREE THAT HUMAN TRAFFICKING IS HORRIFYING, AND THAT TRAFFICKING WITHIN MASSAGE SETTING IS A REAL AND SERIOUS CONCERN. LICENSED SOLE PRACTITIONERS WHO OPERATE PROFESSIONAL THERAPEUTIC PRACTICES ARE VERY DIFFERENT FROM ILLICIT OPERATIONS, AND REGULATIONS SHOULD REFLECT THOSE DIFFERENCES. LOUISVILLE HAS ROUGHLY 350 MASSAGE THERAPISTS, AND APPROXIMATELY 75% OF THEM ARE WOMEN. THE MAJORITY OPERATE AS SOLE PRACTITIONERS. I HAVE BEEN A MASSAGE THERAPIST IN LOUISVILLE SINCE 2015 AND HAVE ADVANCED TRAINING IN ONCOLOGY, MASSAGE, LYMPHATIC DRAINAGE AND LYMPHEDEMA MANAGEMENT. SAFETY IS ALWAYS PARAMOUNT FOR BOTH PRACTITIONERS AND CLIENTS.

TRUST, PROFESSIONALISM AND CONTROLLED ACCESS TO THE SPACE ARE ESSENTIAL FOR THIS WORK TO OCCUR SAFELY. WHILE THIS ORDINANCE ALLOWS SOLE THERAPISTS TO LOCK THEIR OUTER OFFICE DOORS, IT DOES NOT RECONCILE THAT ALLOWANCE WITH INSPECTION REQUIREMENTS. MOST INDEPENDENT THERAPISTS WORK BY APPOINTMENT ONLY AND SCHEDULE CLIENTS BACK TO BACK. THERE IS NO RECEPTIONIST AND NO DOWNTIME BUILT INTO THE SCHEDULE. UNANNOUNCED INSPECTIONS WOULD BE EXTREMELY DIFFICULT TO ACCOMMODATE WITHOUT DISRUPTING CLIENT CARE AND PRIVACY. THE QUESTION IS HOW WOULD AN INSPECTION OCCUR WHILE A CLIENT IS ON THE TABLE? MOST SOLE PRACTITIONERS HAVE ONLY ONE TREATMENT ROOM, AND INSPECTORS CANNOT ENTER THAT SPACE WITHOUT VIOLATING CLIENT PRIVACY. THIS CREATES A DIRECT CONFLICT BETWEEN INSPECTION ACCESS, CLIENT PRIVACY, AND PRACTITIONER SAFETY. APPLYING A REGULATORY FRAMEWORK DESIGNED FOR MULTI EMPLOYEE FACILITIES TO SINGLE PROVIDER PRACTICES DOES NOT REFLECT THE ACTUAL RISK PROFILE OF THOSE. SO PRACTITIONER BUSINESSES. I'M ASKING THE COUNCIL TO CLARIFY THE DEFINITION OF MASSAGE FACILITY. A MASSAGE FACILITY SHOULD BE DEFINED AS A BUSINESS ENTITY THAT OPERATES UNDER A SINGLE OWNER OR MANAGEMENT STRUCTURE, AND OFFERS MASSAGE SERVICES THROUGH MULTIPLE EMPLOYEES OR CONTRACTORS. A LOCATION IN WHICH LICENSED MASSAGE THERAPIST OPERATES AS A SOLE PRACTITIONER, EACH MAINTAINING THEIR OWN BUSINESS PRACTICES SHOULD NOT BE CONSIDERED MASSAGE FACILITY. I URGE THE COUNCIL TO AMEND THIS ORDINANCE BY ADOPTING A DIFFERENT APPROACH TO SOLE PRACTITIONERS. UNDER THIS MODEL, SOLE PRACTICING THERAPIST MAY APPLY FOR AN EXEMPTION BY PROVIDING PROOF OF CURRENT MASSAGE LICENSURE, GOVERNMENT ISSUED IDENTIFICATION, AS WELL AS A COPY OF AN EXECUTED LEASE WHERE THE OFFICE IS LOCATED, EXEMPTING THIS EXEMPTION TO LEGITIMATE PRACTICE, PRACTITIONERS WOULD ALLOW THE CITY TO VERIFY LICENSURE AND MAINTAIN APPROPRIATE OVERSIGHT.

FOCUS ENFORCEMENT RESOURCES ON ACTUAL HIGH RISK OPERATIONS, AND AVOID UNNECESSARY ADMINISTRATIVE BURDEN AND REDUNDANCY. I AM HERE TODAY IN SUPPORT OF THE INTENTION OF THE LOUISVILLE, THE LOUISVILLE'S NEW MASSAGE FACILITY ORDINANCE. BUT WHAT I WANT TO DO TODAY IS EXPLAIN HOW THIS ORDINANCE AFFECTS MY BUSINESS AS AN EMPLOYER, AND TO ASK FOR HELP NAVIGATING THIS TRANSITION FULL TIME. WORK AS A MASSAGE THERAPIST IS TYPICALLY AROUND 20 HANDS ON HOURS PER WEEK, DUE TO THE PHYSICAL DEMANDS OF THE JOB. IN LOUISVILLE, MOST STUDIOS OPERATE ON A ROOM RENTAL MODEL, OR THERAPISTS WORK FOR A FRANCHISE THAT PAYS AROUND $20 PER HOUR, CREATING A HARD BARRIER TO MAKE A LIVING WAGE AND REDUCE BURNOUT IN THE PROFESSION. AT MCCOSH, I CHOSE A DIFFERENT MODEL WHEN I OPENED MY BUSINESS TWO YEARS AGO. THE PROFIT MARGIN THAT WOULD NORMALLY SUPPORT RECEPTION INSTEAD GOES DIRECTLY TO THE LICENSED PRACTITIONER. THIS ALLOWS ME TO PAY MORE THAN DOUBLE FRANCHISE WAGES AND OFFER W-2 EMPLOYMENT, SO THERAPISTS CAN EARN A LIVING WAGE WITHOUT THE OBSTACLES OF RUNNING A BUSINESS THEMSELVES.

BECAUSE WE ARE APPOINTMENT ONLY, WE CURRENTLY LOCK OUR LOBBY DOOR WHILE SESSIONS ARE IN PROGRESS. UNDER THIS ORDINANCE, I WOULD BE REQUIRED TO HIRE AT LEAST THREE ADDITIONAL EMPLOYEES SIMPLY TO SAFELY KEEP DOORS UNLOCKED DURING OPERATING HOURS. THIS CHANGE MORE THAN DOUBLES MY FIXED EXPENSES OVERNIGHT. IF I HADN'T HAPPENED TO CHECK FACEBOOK LAST NOVEMBER, I WOULD NOT KNOW ABOUT THIS ORDINANCE. I NEED MORE TIME. I AM PRIVILEGED THAT I HAVE A GROWING BUSINESS AND A STRONG RELATIONSHIP WITH MY COMMERCIAL BANKER, WHICH ALLOWED ME TO BEGIN THE PROCESS OF APPLYING FOR AN SBA LOAN AS SOON AS I FOUND OUT. HOW LONG WILL THOSE WHO HAVE YET TO HEAR ABOUT THIS ORDINANCE HAVE BEFORE IT IS ENFORCED? I WAS ABLE TO SECURE ROUGHLY FIVE MONTHS OF WORKING CAPITAL TO TRY TO MAKE MY BUSINESS VIABLE AGAIN. WITH ALL THE ADJUSTMENTS I MUST MAKE, IF I CANNOT MORE THAN DOUBLE MY SALES IN SIX MONTHS, I WILL HAVE TO CLOSE AND DISTRICT EIGHT WILL LOSE A SMALL BUSINESS THAT GROSSED OVER A QUARTER MILLION DOLLARS ITS SECOND YEAR, AND WHO IS DEDICATED TO PROVIDING GOOD WAGES TO RESIDENTS IN LOUISVILLE. SO MY ASK IS THIS IF IT TAKES LESS THAN A MINUTE TO VERIFY A SAFE MASSAGE LICENSE? AND IF THE CITY IS NOT RECEIVING SUFFICIENT SUPPORT FROM THE STATE TO REGULATE ILLEGITIMATE BUSINESSES, IS IT POSSIBLE TO EXTEND ADDITIONAL, EVEN TEMPORARY EXEMPTIONS TO FACILITIES STAFFED ENTIRELY BY STATE LICENSED MASSAGE THERAPISTS, PARTICULARLY AROUND OPERATIONAL REQUIREMENTS LIKE UNLOCKED DOORS? CLINICS LIKE MINE ALREADY MANAGE SENSITIVE PERSONAL, FINANCIAL AND MEDICAL INTAKE INFORMATION, REQUIRE AN ADDITIONAL GOVERNMENT ISSUED IDENTIFICATION, CREATES UNNECESSARY DATA COLLECTION, DISCOURAGES LAWFUL CLIENTS FROM SEEKING CARE, AND DISSUADES THOSE FROM WHO ALREADY FEEL VULNERABLE. ANOTHER HIKE IN LOUISVILLE AREA IS SCHEDULED FOR SATURDAY, NOVEMBER 14TH, VETERANS DAY WEEKEND. WE ARE EXPECTED AROUND 100 PARTICIPANTS FROM ALL OVER KENTUCKY AND THE UNITED STATES. WE ARE PARTNERING WITH LOCAL BUSINESSES, HOTELS, RESTAURANTS AND VETERANS GROUPS. ONE ALARMING STATISTIC THAT RECENTLY WAS SHARED THAT WOMEN ARE 92% MORE LIKELY TO COMMIT SUICIDE THAN CIVILIAN WOMEN.

MILITARY WOMEN ARE. ONE OF THE HARDEST STRUGGLES VETERANS FACE WHEN GETTING OUT IS THE MILITARY OF THE MILITARY IS LOSING THAT SENSE OF CAMARADERIE WITH OUR FELLOW SERVICE MEMBERS. OUR MISSION IS TO HELP VETERANS OUT OF THE ISOLATION AND GIVE THEM A COMMUNITY. THE ELIMINATION ISOLATION ELIMINATES SUICIDE. OUR 2025 NATIONAL SURVEY 57% OF VETERANS PARTICIPATE. PARTICIPANTS REPORT SUICIDE IDEOLOGY STOPPED OR EVEN SNIFFING DECREASED. 41% OF VETERAN PARTICIPANTS STRUGGLING WITH SUBSTANCE ABUSE. REPORT AND MAJOR IMPROVEMENT. 40% OF OUR PARTICIPANTS ARE FEMALES, COMPARED TO COMPRISED OF THE 11% THAT ARE ALL VETERANS. OUR OUR HIKES ARE FOR VETERANS ONLY, BUT WE ENCOURAGE OUR FAMILIES TO COME OUT AND SUPPORT US AND MEET US AT OUR STOPS AND BE WITH US. WE ARE MAKING AN IMPACT.
